Special Area Delivery Service - Terms and Conditions
1. These Terms and Conditions (hereafter referred as “these T&Cs”) are supplementary clauses to the Terms and Conditions of Waybill. The definitions in these T&Cs are consistent with the Terms and Conditions of Waybill.
2. If Shipper uses Special Area Delivery Service, these T&Cs shall apply in conjunction with the Terms and Conditions of Waybill.
3. "Special Area Delivery Service" refers to the Additional Service provided by SF to the Shipper when the receiving address falls into the Special Area where SF will have to provide additional service other than delivery. Definitions herein are as follows:-
3.1 "Special Area" refers to a) addresses shown in any ordering system of SF International that requires special area delivery, such as docks, airports, logistics companies or logistics centers, logistics warehouses, bonded areas, customs supervision areas, conference or exhibition centers, etc.; and b) any other address that may required Additional Services provided by SF although it is not be shown in the ordering system of SF International;
3.2 "Additional Services" refer to services other than shipment pickup and delivery, such as queuing, booking for area delivery, following designated procedures for delivery, waiting for acceptance, advancing fees, loading and unloading, etc.
4. When sending a Shipment to a Special Area, Shipper shall pay SF Special Area Delivery Service Fee based on the additional service . If the Shipment is a document weighing 1KG or less than 1 KG, the Special Area Delivery Service Fee may be waived until further notice from SF. If Shipper does not wish to incur such Special Area Delivery Service Fee, Shipper may choose to:-
4.1 cancel the shipping order before SF's courier picks up the Shipment, re-order and change the receiving address to another one outside the Special Area;
4.2 change the receiving address to another one outside the Special Area if the Shipment has been sent, provided that this circumstance may result in a service fee for changing the delivery address;
4.3 change the delivery method to self-pickup at SF's business point or locker outside the Special Area if the Shipment has been sent; or
4.4 cancel the Special Area Delivery Service in ordering system of SF International (if the ordering system available) or contact SF’s customer service representative to notice that the delivery only needs to be made to the outer entrance of the Special Area and SF’s customer service representative will help to cancel the Special Area Delivery Service.
5. For the coverage of Special Area, please refer to information shown on the ordering system of SF International. SF shall be entitled to make changes of the coverage of Special Areas from time to time at its absolute discretion without prior notice to Shipper and/or Receiver.
6. The charging standards for Special Area Delivery Service are shown on SF official website. SF shall be entitled to make changes of the charging standards from time to time at its absolute discretion without prior notice to Shipper and/or Receiver. The Special Area Delivery Service Fee standard is generally quoted in RMB. If the fees are not paid within the territory of China Mainland, the fees will be converted into the currency of the payment area according to the exchange rate shown on SF’s official website.
7. In the process of the Special Area Delivery Service, if it is necessary to pay relevant fees (such as warehousing-in fee, stacking fee, document fee, inspection fee, THC, management fee, etc.) to the operator or manager of the Special Area before completing the delivery, Shipper agrees to entrust SF to make the payment on behalf of Shipper. Shipper and Receiver shall unconditionally pay off the fees advanced by SF within the period notified by SF, failing which SF shall be entitled to charge interest according to applicable laws.
8. Payment method of the Special Area Delivery Service Fee:
8.1 Shipper may choose to settle the Special Area Delivery Service Fee on credit account payment by Shipper, cash payment by Shipper, credit account payment by Receiver, cash payment by Receiver, or credit account payment by third party designated by Shipper or Receiver (provided that the third party payment permission is granted under the credit account), but the above selected payment method shall be consistent with the payment method of the shipment charges.
8.2 If it is required to pay Special Area Delivery Service Fee due to the addition of the Special Area Delivery Service or the change of the Shipment after the Shipment is sent, and if:-
a) Shipper chooses credit account payment by Shipper, or credit account payment by third party designated by Shipper or Receiver, Special Area Delivery Service Fee will be included in the credit account settlement bill
b) Shipper chooses cash payment by Shipper, Shipper shall pay Special Area Delivery Service Fee according to the requirements of SF ;
c) Shipper chooses credit account payment by Receiver or cash payment by Receiver, SF will charge the Receiver such fees.
8.3 If the Special Area Delivery Service Fee is canceled due to the cancellation of the Special Area Delivery Service after the Shipment is sent, and if:
a) Shipper has already paid the Special Area Delivery Service Fee at the time of sending the Shipment, after the Special Area Delivery Service is successfully canceled, Shipper may contact SF's customer service representative to refund the relevant fees;
b) Shipper choose to settle the fees on credit account payment by Shipper, credit account payment by Receiver or credit account payment by third party designated by Shipper or Receiver, SF will not include such fees in the bill;
c) Shipper choose cash payment by Receiver, SF will not charge the Receiver such fees.
9. If Shipper and/or the Receiver refuses to pay the Special Area Delivery Service Fee according to these T&Cs (including the service fee for changing the delivery address, advanced fees for Special Area Delivery, etc.), SF shall have rights to refuse to deliver the Shipment. If Shipper and/or the Receiver still refuses to pay the Special Area Delivery Service Fee after SF’s payment reminder, it will be deemed that the Shipment is impossible to be delivered, and SF shall be entitled to handle the Shipment as SF deems fit by referring to the similar remedy Article 12 of Terms and Conditions of Waybill regarding the refusal to pay freight and customs duties.
10. If Shipper chooses to have the Special Area Delivery Service Fee (including the service fee for changing the delivery address) paid by Receiver (including credit account payment by Receiver, cash payment by Receiver, and/or credit account payment by third party designated by Receiver) but Receiver refuses to pay, Shipper shall not be exempted from its obligation to pay the said fees, and SF shall have rights to claim such Special Area Delivery Service Fee from Shipper and/or the Receiver at any time and claim compensation for any losses caused thereby.
11. Shipper shall provide correct and valid Shipper and Receiver addresses and contact information, and provide convenience at the delivery destination to ensure the smooth delivery of the Shipment.
12. Shipper and/or Receiver will still be required to pay the Special Area Delivery Service Fee if:-
12.1 the address or contact information filled in by Shipper or Receiver is incorrect, causing the receiving address to fall within a Special Area;;
12.2 the address or contact information filled in by Shipper or Receiver is incorrect, so that Shipment is mistakenly delivered to a Special Area or delayed or unable to be delivered;
12.3 after SF completes the Special Area Delivery Service, entry into the receiving address is prohibited or refused, or the entry procedures are cumbersome, or no one answers the door, leading to inability to complete the door-to-door delivery;
12.4 after SF completes the Special Area Delivery Service, Shipper and/or Receiver requests to change to self-pickup at SF's business point or locker or request to return the Shipment; and/or
12.5 any event of force majeure as stipulated in Article 14 of Terms and Conditions of Waybill happened.
13. SF has the absolute discretion to decide whether to provide or withdraw Special Area Delivery Service at any time, and reserves the right to change any provisions of these T&Cs at any time without any prior notice. Any modification will take effect immediately and be binding when it is published on the official website of SF. In the event that the Service is withdraw by SF due to SF’s reason, SF will refund the Special Delivery Service Fee to Shipper or Receiver.
14. If any provision hereof is held by any court or other authority to be invalid or unenforceable in whole or in part, the remaining provisions of these T&Cs and the remaining contents of the affected provision shall remain valid. Failure or delay in enforcing any provision under these T&Cs will not constitute a waiver of such provision.
15. Governing Laws and Dispute Resolution shall be consistent with those of T&Cs of Waybill of the original country or region.
16. In case of any discrepancy between the Chinese and English versions of these T&Cs, the Chinese version shall prevail.
